Half Moon Bay Homes - 2nd Lien Extinguished for Borrower

                                                 Borrower Gets 2nd Lien Removed

I have written a few times on the National Mortgage Settlement that has the nations biggest banks give relief of some sort to distressed homeowners.  The relief has come in different ways...short sale settlement, cash to relocate, principle reductions, loan modifications and maybe even wiping away the lien altogether.

Currently I have been working on a short sale where just recently, the 2nd lien holder was able to get the entire

$132,000 second lien removed, extinguished, gone.  Great for the homeowner and great for me, for i no longer have to work on the 2nd lien short sale.  This does not affect any current 1st lien activity.  Your first lien is separate and needs to be handled accordingly.

Fannie / Freddie slay the short sale DRAGON

                           Mortgage Insurance Delegation Approved for Fannie Mae / Freddie Mac

 

Why did your short sale note get approved ?  Why did it take so long?  One of the many reasons could be that your lien holder took out a Mortgage Insurance policy on your loan.  No, Mr. Amateur Short Sale agent, it is not the MI you think it is.  

Mortgage Insurance has been a pain in my A** for years.  The servicer and the investor all agree to terms on a short sale, however, a third party monster called (Mortgage Insurance) sometimes will kill the deal or extend it until it gets closer to the foreclosure date.  To move forward, the MI company will need to sign off on the short sale.  Very few servicers have the authority or strength to battle the MI company to agree to terms.  I would usually have to go around my servicer and negotiate with the MI company directly to get my approval in hand.

GOOD NEWS!  For most loans in the country, meaning all Fannie Mae and Freddie Mac loans, all major MI companies have delegated the authority to sign off on the short sale to the servicer.   This is great news.  It will shave off weeks in processing and increase the approval ratios of MI backed short sales.

Short Sale Afterlife

                                            When Can I buy After I short sale My Home?

If you have short sold your home in the past couple years and are wondering  how that has affected your ability to buy now, read the information provided below.  (confirm with your mortgage professional) 

If you short sold your home and you apply for a mortgage it depends on what type of financing, how long after the short sale, and how much of a down payment. 

FHA Financing:

Probably your best chance after a short sale.  About a 3 year wait time. 

VA Loan Financing:

If you are a veteran of the armed forces and have short sold a home, your wait time is 2 years.  

Conventional Financing:

There are some conventional programs out there today that borrowers can put as little as 5% down with conventional loan mortgage insurance.  However, if you have short sold a home, you will most likely need to wait 3-4 years and also have at least 20% down payment.  Conventional investors vary. 

Jumbo Loan Financing:

If you are looking to finance a loan that is above conventional conforming limits (high cost area) you will have to wait the longest.  The wait for a jumbo loan is 7 years.  The high cost loan limit is $729,750.

USDA Financing:

There is no written guideline but I have been told 2 years.

                        Will the Mortgage Debt Relief Act Extended?

What is it?  Here is the IRS definition:

he Mortgage Debt Relief Act of 2007 generally allows taxpayers to exclude income from the discharge of debt on their principal residence. Debt reduced through mortgage restructuring, as well as mortgage debt forgiven in connection with a foreclosure, qualifies for the relief.

This provision applies to debt forgiven in calendar years 2007 through 2012. Up to $2 million of forgiven debt is eligible for this exclusion ($1 million if married filing separately). The exclusion does not apply if the discharge is due to services performed for the lender or any other reason not directly related to a decline in the home’s value or the taxpayer’s financial condition

In plain terms:  

When a person sells their home for less than what they owe on a mortgage, the difference is shifted to the seller by the mortgage lender as INCOME.  Income is taxed!  Since 2007, that added income has been waived on approved short sale taxpayers.  This Act expires in 2012.
